This Privacy Notice describes how JobNimbus, LLC (“JobNimbus”) and our affiliates, ContractorBoost.ai (“Contractor Boost”), Roofer Marketers LLC (“Roofer Marketers”), and Sumo Quote Inc. (“Sumo Quote”) (collectively, the “JobNimbus Companies,” “we,” “us,” “our”) collect, use and disclose information about individuals who use our websites (https://www.jobnimbus.com/, https://jobnimbusmarketing.com/, https://contractorboost.ai, and https://www.sumoquote.com), applications, services, tools, and features, or otherwise interact with us (collectively, the “Services”). For the purposes of this Privacy Notice, “you” and “your” means you as the user of any of the Services, whether you are a customer, website visitor, job applicant, representative of a company with whom we do business, or another individual whose information we have collected pursuant to this Privacy Notice. The Services are intended primarily for users located in the United States and Canada only and are not intended for users located outside the United States or Canada.

Please read this Privacy Notice carefully. By using any of the Services, you agree to the collection, use, and disclosure of your information as described in this Privacy Notice. If you do not agree to this Privacy Notice, please do not use or access the Services.

1. Changes to This Privacy Notice

We may modify this Privacy Notice from time to time, in which case we will update the “Last Updated” date at the top of this Privacy Notice. If we make material changes to the way in which we collect, use or disclose personal information, we will use reasonable efforts to notify you (such as by emailing you at the last email address you provided us, by posting notice of such changes on the Services, or by other means consistent with applicable law) and will take additional steps as required by applicable law. If you do not agree to any updates to this Privacy Notice, please do not continue using or accessing the Services.

2. Collection and Use of Your Information

When you use or access the Services, we collect certain categories of information about you from a variety of sources.

Information You Provide to Us

Some features of the Services may require you to directly provide us with certain information about yourself. You may elect not to provide this information, but doing so may prevent you from using or accessing these features. Information that you directly submit through our Services includes:

  • Identifiers: name, address, phone number, and email, account username, password, and unique personal identifier.
  • Financial Information: Credit or debit card information, bank account information, or other financial details and billing address, which we collect and process using a third-party payment processor.
  • Commercial Information: Records of products or services purchased, obtained, or considered, or other purchasing or consuming histories.
  • Internet/Network: Browsing history, search history, information regarding a consumer’s interaction with an internet website, application, or advertisement.
  • Any other information you choose to include in communications with us, for example, when communicating with us through the Services.

Information We Collect Automatically

We also automatically collect certain information about your interaction with the Services (“Usage Data”). To do this, we may use cookies, web beacons, or geolocation tracking technologies, etc. (“Tracking Technologies”). Usage Data includes:

  • Device information, such as device type, operating system, unique device identifier, and internet protocol (IP) address.
  • Location information, such as approximate location / precise geolocation, if you choose to provide it.
  • Other information regarding your interaction with the Services, such as browser type, log data, date and time stamps, clickstream data, interactions with marketing emails, and ad impressions.

We use Usage Data to tailor features and content to you, market to you, provide you with offers or promotions, run analytics, and better understand user interaction with the Services. Information Collected from Other Sources

We may obtain information about you from outside sources, including information that we collect directly from third parties and information from third parties that you choose to share with us. Such information includes:

  • Analytics data we receive from analytics providers such as Pendo, UserPilot, Google Analytics, Meta Insights.
  • Information we receive from recruiting platforms, such as LinkedIn, Monster, or Indeed, which we use to process your application for employment.
  • Information we receive from consumer marketing databases or other data enrichment companies, which we use to better customize advertising and marketing to you.

Any information we receive from outside sources will be treated in accordance with this Privacy Notice. We are not responsible for the accuracy of the information provided to us by third parties and are not responsible for any third party’s policies or practices. Sensitive Personal Information

Depending on how you use the Services, we may collect certain categories of sensitive personal information, such as:

  • Account credentials (including usernames and passwords);
  • Payment card or other financial account information processed in connection with transactions;
  • Precise geolocation information, if you choose to enable location-based features; and
  • Other information that may be considered sensitive personal information under applicable law.

We use sensitive personal information only as reasonably necessary to provide the Services, process transactions, maintain and secure accounts, detect and prevent fraud, comply with legal obligations, and for other purposes permitted by applicable law. We do not use sensitive personal information to infer characteristics about individuals.

In addition to the specific uses described above, we may use any of the above information to provide you with the Services and to maintain our business relationship with you, including by enhancing the safety and security of our Services (e.g., troubleshooting, data analysis, testing, system maintenance, and reporting), providing customer support, sending service and other non-marketing communications, monitoring and analyzing trends, conducting internal research and development, complying with applicable legal obligations, enforcing any applicable terms of service, and protecting the Services, our rights, and the rights of our employees, users or other individuals.

Finally, we may deidentify or anonymize your information such that it cannot reasonably be used to infer information about you or otherwise be linked to you (“deidentified information”) (or we may collect information that has already been deidentified/anonymized), and we may use such deidentified information for any purpose. To the extent we possess or process any deidentified information, we will maintain and use such information in deidentified/anonymized form and not attempt to re-identify the information, except solely for the purpose of determining whether our deidentification/anonymization process satisfies legal requirements.

3. Cookies and Other Tracking Technologies

Most web browsers automatically accept cookies; however, you may be able to modify your browser settings to decline or delete cookies. Please note that disabling certain cookies may affect the functionality of the Services and may cause some features to operate improperly. Where available, you may also manage your cookie preferences through our cookie consent or preference management tools. Additional information regarding the cookies and tracking technologies we use may be provided through those tools.

Depending on your location and applicable law, the manner in which cookies and similar tracking technologies are deployed may differ. For example, visitors from certain jurisdictions may be asked to provide consent before non-essential cookies or similar technologies are placed on their device, while visitors from other jurisdictions may be provided with the ability to manage or opt out of non-essential cookies after they are deployed.

4. Sharing of Mobile Information

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All categories in this privacy policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

5. SMS and Text Messaging Communications

If you choose to receive text messages from JobNimbus, we may send you transactional, operational, support, account-related, and, where permitted, marketing messages.

By providing your mobile phone number and opting into text messages, you consent to receive recurring automated or non-automated text messages from JobNimbus at the number provided. Consent to receive marketing text messages is not a condition of purchasing any goods or services. Message frequency may vary. Message and data rates may apply.

You may opt out of receiving text messages from JobNimbus at any time. To stop receiving messages, reply “STOP” to any text message. Upon doing so, you will be removed from our messaging list. Message and data rates may apply based on your mobile provider.

We may use third-party service providers to facilitate the delivery of text messages.

6. Customer Data and Processor Role

When customers upload, store, or manage information concerning their own customers, employees, leads, vendors, or contacts, JobNimbus generally acts as a processor, service provider, or similar role under applicable privacy laws. Customers remain responsible for determining the legal basis and purpose of processing such information, for providing any required notices, obtaining any required consents, and providing privacy notices to individuals whose personal information they submit through the Services.

7. How We Use Personal Information

We use information that we collect about you or that you provide to us, including any personal data, to:

  • Provide you with the Services and any contents, features, information, products, or services that we make available through the Services.
  • Create and manage accounts.
  • Process transactions and payments.
  • Comply with legal obligations.
  • Provide you with notices about your account, including expiration and renewal notices.
  • Improve our Services, including by analyzing your information and creating aggregated data derived from your information to develop, maintain, analyze, improve, optimize, measure, and report on our Services and their features and how users interact with them.
  • Carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
  • Notify you when Services updates are available and about changes to any products or services we offer or provide though them.
  • For any other purpose with your consent.

8. Disclosure of Your Information

We will only disclose your information to third parties as set forth in this Privacy Notice, and only to the following categories of third parties:

  • Our affiliates or others within our corporate group, including, without limitation, the JobNimbus Companies.
  • Vendors or other service providers who help us provide the Services, including for system administration, cloud storage, security, customer relationship management, marketing services, communications, web analytics, payment networks, and payment processing.
  • Marketing service providers and business partners to assist us in marketing our own products and services or where you have directed us to share your information. We contractually require these third parties to keep personal data confidential and use it only for the purposes for which we disclose it to them.
  • Third parties to whom you request or direct us to disclose information, such as through your use of social media widgets or login integration.
  • Professional advisors, such as auditors, law firms, or accounting firms.
  • Third parties in connection with or anticipation of an asset sale, merger, or other business transaction, including in the context of a bankruptcy.

We may also disclose your information as needed to comply with applicable law or any obligations thereunder or to cooperate with law enforcement, judicial orders, and regulatory inquiries, to enforce any applicable terms of service, and to ensure the safety and security of our business, employees, and users.

9. Marketing and Targeted Advertising

We may use advertising, analytics, and measurement technologies to evaluate the effectiveness of our marketing campaigns, improve our Services, and present relevant content where permitted by applicable law and consistent with users’ consent choices.

Depending on your location and applicable law, you may have the ability to manage your preferences for certain advertising, analytics, and tracking technologies through our cookie preference center or other available privacy controls.

Users may unsubscribe from promotional emails using the unsubscribe links contained in marketing communications. Please note that even if you opt out of marketing communications, we may continue to send you transactional, service-related, security, or account communications.

Mobile Information Sharing

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

10. Third-Party Websites and Links

We may provide links to third-party websites or platforms. If you follow links to sites or platforms that we do not control and are not affiliated with us, you should review the applicable privacy notice, policies, and other terms. We are not responsible for the privacy or security of, or information found on, these sites or platforms. Information you provide on public or semi-public venues, such as third-party social networking platforms, may also be viewable by other users of the Services and/or users of those third-party platforms without limitation as to its use. Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators.

11. Children’s Privacy

Children under the age of 13 are not permitted to use the Services, and we do not seek or knowingly collect any personal information about children under 13 years of age. If we become aware that we have unknowingly collected information about a child under 13 years of age, we will make commercially reasonable efforts to delete such information. If you are the parent or guardian of a child under 13 years of age who has provided us with their personal information, you may contact us using the below information to request that it be deleted.

12. Artificial Intelligence and Automated Features

Certain Services may utilize artificial intelligence (“AI”), machine learning, or automated decision-support technologies. These features may assist with content generation, workflow automation, sales and marketing activities, lead qualification, analytics, customer communications, and productivity enhancements.

Information submitted to AI-enabled features may be processed by JobNimbus and authorized service providers. Users should independently review AI-generated outputs before relying on them. AI outputs may contain inaccuracies, omissions, or outdated information. We do not use AI-enabled processing to make solely automated decisions that produce legal or similarly significant effects on individuals.

13. Data Security and Retention

We maintain administrative, technical, and physical safeguards designed to protect personal information. Measures may include encryption in transit, access controls, authentication requirements, security monitoring, role-based permissions, vendor management programs, and incident response procedures.

Despite our reasonable efforts to protect your information, no security measures are perfect, and no method of transmission or storage can guarantee absolute security. Any information you send to us electronically, while using the Services or otherwise interacting with us, may not be secure while in transit. We recommend that you do not use unsecure channels to send us sensitive or confidential information.

Where we use service providers who might have access to your personal information, we select them carefully and require them to have privacy and security standards that are comparable to ours. We use contracts and other measures with our service providers to maintain the confidentiality and security of your personal information and to prevent it from being used for any other purpose.

We retain your information for only as long as is reasonably necessary for the purposes specified in this Privacy Notice. When determining the length of time to retain your information, we consider various criteria, including whether we need the information to continue to provide you the Services, resolve a dispute, enforce our contractual agreements, prevent harm, promote safety, security and integrity, or protect ourselves, including our rights, property or products. We maintain records of SMS consent where required for compliance, fraud prevention, dispute resolution, and legal obligations.

Security Incident Notification

If a security incident involving personal information occurs, we will investigate the matter and provide notifications as required by applicable law.

14. California Residents

This section applies to you only if you are a user of the JobNimbus website or apps and a California resident (“resident” or “residents”). For purposes of this section, references to “personal information” shall include “sensitive personal information,” as these terms are defined under the California Consumer Privacy Act (“CCPA”).

Processing of Personal Information

In the preceding 12 months, we collected and (where indicated below) disclosed for a business purpose the following categories of personal information and sensitive personal information (denoted by *) about residents:

We only use and disclose sensitive personal information for the purposes specified in the CCPA. The criteria we use to determine how long to retain your personal information is described in the section above, Data Security and Retention.

We disclosed personal information over the preceding 12 months for the following business or commercial purposes:

  • to communicate with you, provide you with products and services, to market to you, etc.
  • to maintain and secure your account with us
  • to process your payment, to provide you with products or services you have requested
  • to evaluate your candidacy and process your application for employment.

Selling and/or Sharing of Personal Information

We do not sell personal information for monetary consideration.

Where we use advertising, analytics, or similar technologies, we do so in accordance with applicable law and users’ consent or privacy preferences. Where applicable law provides the right to opt out of targeted advertising, cross-context behavioral advertising, or similar processing activities, users may exercise those rights through our cookie preference center, recognized browser privacy signals where supported, or by contacting us using the information provided below.

Further, we do not have actual knowledge that we “sell” or “share” personal information of residents under 16 years of age.

Your California Privacy Rights

As a California resident, you may have the rights listed below in relation to personal information that we have collected about you. However, these rights are not absolute, and in certain cases, we may decline your request as permitted by law.

We may need to collect information from you to verify your identity, such as your email address, government-issued ID, or date of birth, before providing a substantive response to the request. You may designate, in writing or through a power of attorney document, an authorized agent to make requests on your behalf to exercise your rights. Before accepting such a request from an agent, we will require that the agent provide proof you have authorized them to act on your behalf, and we may need you to verify your identity directly with us.

15. Residents of Other U.S. States

Depending on your state of residence, you may have rights to:

  • Right to Access. You may have a right to request that we confirm whether we process information about you and give you access to that information in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the information to another business without impediment.
  • Right to Delete. You may have a right to request that we delete information we maintain about you.
  • Right to Correct. You may have a right to request that we correct inaccurate information we maintain about you.

We may need to collect information from you to verify your identity, such as your email address, government-issued ID, or date of birth, before providing a substantive response to the request. Depending on your location, you may designate, in writing or through a power of attorney document, an authorized agent to make requests on your behalf to exercise your rights. Before accepting such a request from an agent, we will require that the agent provide proof you have authorized them to act on your behalf, and we may need you to verify your identity directly with us. Applicable rights vary by jurisdiction.

In addition, you may have the right to appeal our decision regarding a request related to these rights by contacting us using the information provided below. When you submit a request or launch an appeal, we will limit our collection of your information to only what is necessary to securely fulfill your request or process your appeal. We will not require you or your authorized agent to pay a fee for the verification of your request or appeal.

16. Canadian Residents

Some of our service providers may be located outside of the United States and Canada. As a result, your personal information will be used, stored, and/or accessed in countries outside of Canada, including the United States. However, all such information will be protected in accordance with this Privacy Notice. Please note that when your personal information is located outside of Canada, it will be subject to the laws of the country in which it is situated.

If you are a resident of Canada, you have the right to access and correct personal information we hold about you. If you are a resident of the province of Quebec, in certain circumstances, you may also have: (i) the right to request that we cease disseminating your personal information; (ii) the right to request that we de-index any hyperlink attached to your name that provides access to information by a technological means; (iii) the right to request that we re-index a link providing access to information; or (iv) the right to request that we communicate to you, as well as to any person or body authorized by law to collect such information, any computerized personal information collected from you in a commonly used technological format.

When requesting access to or seeking to enforce any of your rights regarding your personal information, we may request specific information from you to enable us to confirm your identity.

Please note that your right to access the information that we hold about you is not absolute. There are instances where applicable law or regulatory requirements allow or require us to refuse to provide some or all of the personal information that we hold about you, such as when such information also includes the personal information of a third party. In addition, the information may have been destroyed, erased, or made anonymous in accordance with our record retention obligations and practices. In the event that we cannot provide you with access to your personal information, we will inform you of the reasons why, subject to any legal or regulatory restrictions.

17. International Data Transfers

Personal information may be transferred to, stored in, and processed in the United States and other countries where JobNimbus, its affiliates, or its service providers operate. These countries may have data protection laws that differ from those in your country of residence.

Where required by applicable law, we implement appropriate safeguards for international transfers of personal information, including the use of Standard Contractual Clauses approved by the European Commission, the UK International Data Transfer Addendum, or other legally recognized transfer mechanisms.
